Customer
SurfPage provides this WEB Site and associated services for the sole use of CUSTOMER.
SurfPage assumes no liability for any claims resulting from CUSTOMER's use of this WEB
Site, and assumes no responsibility or liability for any third party. This includes but is
not limited to any fees, taxes, damages for nonperformance, or WEB Site maintenance
services.
Use Policy
SurfPage provides this WEB Site and associated services for legal business activity.
Therefore, SurfPage as a policy prohibits the storage or transfer of objectionable
information which includes but is not limited to any illegal, obscene, lewd, satanic, or
threatening information or any violation of copyrights or trade secrets. If SurfPage
determines in its sole judgment that CUSTOMER stores or transfers such objectionable
information, then it will notify CUSTOMER of the violation via E-mail. If CUSTOMER does
not remedy the problem within 24 hours, then all of CUSTOMER's Storage space will be
erased and CUSTOMER's account will be canceled.
Set-up
CUSTOMER will provide all files and information in an appropriate format as is required by
SurfPage to set-up CUSTOMER's WEB Site. CUSTOMER is solely responsible for the function,
the information integrity, and the back-up of the files stored in its WEB Site Storage
Space. SurfPage assumes no liability for any damages caused by the loss of files for any
reason from CUSTOMER's WEB Storage Space.
Limited Warranty
SurfPage warrants that CUSTOMER's Storage Space will be available for access by users of
the Internet. In the event that SurfPage's WEB Server is not operational, then SurfPage
will reduce the next billing to the CUSTOMER by a percentage equal to the percentage of
accumulated down time. This is the only remedy available to CUSTOMER, and SurfPage assumes
no liability expressed or implied for any consequential damages to CUSTOMER or to third
parties as a result of WEB Server down time. SurfPage does not warrant that information
stored in or being transferred from or to CUSTOMER's Storage Space will not be destroyed
or altered. SurfPage does not warrant merchantability or fitness for a particular purpose.
Cancellation
SurfPage may cancel CUSTOMER's account for any reason and erase all data from its Storage
Space. Reasons for such action include but are not limited to; 1) a delinquency in paying
any fees, or 2) the violation of the WEB Site Use Policy. CUSTOMER may cancel at any time
by written notice sent to and acknowledged by SurfPage. Billing for the current period
will not be refunded in the event of cancellation.
Extra Bandwidth and Storage Space
Each SurfPage WEB Site is allocated a specific amount of Bandwidth (Megabytes per month)
and Storage Space (Megabytes). In the event addittional storage space is requested or band
